These Terms & Conditions govern the design, packaging, and artwork management services provided by Skyniv Atelier. By utilizing our services, you agree to the following standard business terms.
Professional Services & Deliverables
Skyniv Atelier provides graphic design and structural packaging artwork creation services. Specific deliverables, deadlines, and project costs will be mutually finalized in writing via independent project estimates or work orders before project commencement.
Intellectual Property & Ownership Rights
Working Files: All preliminary drafts, design concepts, and intermediate working files generated during the execution stage remain the property of Skyniv Atelier.
Final Transfer: Complete ownership and intellectual property rights of the finalized, approved, print-ready digital files will be transferred to the client only after full payment of the respective invoice is received.
Invoicing and Payments
Invoicing and billing terms will be specified in the project agreement. Skyniv Atelier reserves the right to suspend work or delay the release of final print-ready deliverables if payments are not made according to the agreed schedule.
Final Review & Client Sign-Off
Verification Responsibility: While Skyniv Atelier performs standard internal quality checks, the final responsibility for verification lies entirely with the client.
The client’s quality and regulatory teams must thoroughly review and verify all technical data, including spelling, barcode details, warning text, and dimensions, before giving final design approval.
Final design approval given by the client (via email or our digital project tracking systems) constitutes an absolute authorization to close the project. Skyniv Atelier is not responsible for any errors discovered after final approval has been granted.
Limitation of Liability
Skyniv Atelier, its partners, and team members shall not be held liable for any indirect, incidental, or consequential commercial damages—including, but not limited to, product recalls, manufacturing delays, inventory losses, or regulatory penalties—resulting from any design or artwork errors.
Our total financial liability for any claim or dispute under any circumstances shall be strictly capped at the total amount paid by the client for that specific individual artwork project under the corresponding invoice.
Force Majeure
Skyniv Atelier is not responsible for project delays caused by events beyond our reasonable control, including sudden government regulatory changes, technical infrastructure outages, or unexpected industry updates.
Jurisdiction
These terms are governed by the laws of India. Any disputes or legal issues arising from our services shall be subject to the exclusive jurisdiction of the competent courts in Uttar Pradesh, India
